CIS Fraud Record: Consequences for Delft Residents and Removal via Local Assistance

A CIS fraud record can exclude Delft residents from insurance for years. Read how to obtain access, lodge an objection and have an incorrect entry removed via the Rechtbank Den Haag or the Juridisch Loket Delft.

3 min leestijd

An international TU student cycles in the evening along the Phoenixstraat, collides with a car and submits a damage claim. Three months later every insurer rejects his new application. The reason? A silent CIS registration of which he had never heard.

What data does the CIS contain exactly?

The Centraal Informatie Systeem comprises three layers. The External Referral Register (EVR) records cases of proven or strongly suspected fraud; registration lasts a maximum of eight years. The Incident Register notes elevated risks without conclusive evidence, usually for five years. The Risk Register contains general data such as previous claims or residence in a statistically high-risk area.

Who consults the register with every application?

Almost every Dutch non-life, health and life insurer is affiliated. With every quotation or policy check the system automatically verifies whether the applicant appears in the register. A hit almost invariably leads to rejection or substantially increased premiums.

Concrete impact for residents of Delft

  • Refused policies with nearly all insurers
  • Higher premiums in the event of exceptional acceptance
  • No mortgage without buildings insurance for a property on the Oude Delft
  • Termination of existing contracts in serious cases
  • Difficulties with credit applications when banks also consult the registers

How do you request access?

Pursuant to the AVG you are entitled to an overview. Send a signed request together with a certified copy of your proof of identity to Stichting CIS, Antwoordnummer 4860, 3500 ZL Utrecht. Within thirty days you will receive a complete overview. Access is free of charge.

Steps to have an incorrect entry removed

Follow this route:

Step 1: request the complete file

Request the full fraud file from the insurer that placed the entry. It must state which facts led to the registration.

Step 2: submit a reasoned objection

Send a written notice of objection containing your counter-arguments, any supporting evidence and an explicit request for removal. The insurer must respond within four weeks.

Step 3: Kifid or Juridisch Loket Delft

If the objection is rejected you may apply to the Kifid. The Juridisch Loket Delft can also assist in drafting the objection. The procedure takes six to twelve months.

Step 4: interim injunction proceedings before the Rechtbank Den Haag

In complex or urgent cases you may initiate interim injunction proceedings before the Rechtbank Den Haag for immediate removal or damages.

Possible damages

According to the Hoge Raad an insurer is liable for damage resulting from an incorrect registration. This includes missed policies, additional premium costs and legal fees. Amounts range from several thousand to tens of thousands of euros.

Important time limits

  • Limitation period: five years from the moment you became aware of the registration
  • Maximum EVR duration: eight years, after which automatic removal
  • Kifid time limit: one year after the written rejection of your objection

Practical advice from the Phoenixstraat

If you notice that policies are being refused without a clear reason, request access immediately. Residents near TU Delft or along the canals sometimes discover an incorrect entry only after several years. The Arslan office at Phoenixstraat 16, 2611 AL Delft (070 – 4500 300) can assist with the first steps. Acting promptly prevents years of financial restrictions.
