The transitievergoeding is a statutory compensation for employees upon dismissal, regulated in article 7:673 of the Dutch Civil Code. This compensation helps in finding new work. For residents of Delft, employment law falls under the District Court of The Hague (district). The Juridisch Loket Delft offers free advice. This article explains how you in Delft are entitled to transitievergoeding, the calculation and conditions.

What does the transitievergoeding entail for residents of Delft?

Upon dismissal on the employer's initiative or mutual termination (from 1 July 2015, Work and Security Act), the employer must pay. It supports financial bridging, retraining or job search in the Delft region. The compensation depends on years of service and salary and can exist alongside other arrangements.

Statutory basis: article 7:673 DCC

Article 7:673 DCC obliges the employer to pay upon:

  • Dismissal on employer's initiative
  • Settlement agreement with employer as driving force
  • Calculation based on length of service and salary
  • Exceptions such as probationary period or bankruptcy

For contracts up to 10 years, 1/6 monthly salary per year of service applies; thereafter 1/4.
